TERMS AND CONDITIONS

By purchasing a membership with GroundWork Training you agree that you accept the following terms and conditions

Membership fees and categories

(a) Membership fees shall be fixed by Katherine Berlie and Matthew Hansell of GroundWork Training and may be altered at any time. Members will be notified (by notices posted on gym notice boards or in writing via email or via GroundWork Training’s membership system) of any changes in the fees prior to the date of the alteration.

(b) On payment of membership fees, a member is entitled to use the gym facilities, subject to class timetable, with frequency of use relating to the membership type.

(c) The first membership subscription shall be due and payable upon entering into this agreement, followed by subsequent monthly payments.

(d) GroundWork Training reserves the right to reject an application for membership, or refuse admission, without ascribing any reason.

(e) GroundWork Training reserves the right to introduce, withdraw and vary categories of membership at any time.

Membership cancellations and freezes

(a) If you are on a month by month contract, you may give us written notice of your wish to cancel at any time, requests received before or on the 17th of a calendar month will be processed at the end of that given month, those received after the 17th of the month will be processed at the end of the following month. GroundWork Training is not liable to refund any monies should the receipt of cancellation not be received in accordance with this clause.

(b) GroundWork Training does not offer membership freezes.

Use of Sessions

(a) Unused sessions are non refundable and cannot be carried over once expired.

(b) 3 hour’s notice is required for cancellation of a single session. Missed sessions without the appropriate notice will be charged as if attended. Morning classes must be cancelled before 9pm the night before, or they will be charged as if attended.

Use of the Facilities

(a) Membership entitles you to use GroundWork Training’s facilities (subject to these terms and conditions, the class timetable from time to time and the frequency of use relating to your membership type) providing always that GroundWork Training may at any time (and if necessary, without notice) withdraw all or part of its facilities for any period or periods in connection with any cleaning, repair, alteration, maintenance or security work or for reasons beyond the control of GroundWork Training, including but not limited to work carried out by Schwartz Holdings Ltd on GroundWork Training premises.

(b) GroundWork Training reserves the right to refuse admission and/or to expel or suspend your membership forthwith if, in the opinion of GroundWork Training, you cause nuisance or annoyance to other members or guests; and for any misuse of GroundWork Training facilities, or for any other reason which GroundWork Training may deem appropriate.

(c) GroundWork Training does not accept liability for any damage or loss of your money, valuables or other personal property. GroundWork Training reserves the right, at its absolute discretion, to refuse to store any such personal property. Personal property stored in lockers provided by GroundWork Training is stored at your own risk and no liability for the loss or damage thereto will be accepted by GroundWork Training.

Data Protection Act

GroundWork Training abides by the principles of the Data Protection Act 1998 and will keep the information provided by you on computer for the purpose of administrating your membership. In addition we will use your personal details and information to provide you with the services of the Gym and generally in connection with your membership of the Gym for marketing and for administration. We may keep your information for so long as you are a member of the Gym and for a reasonable period thereafter, for these purposes. We may need to share your information with our service providers and agents for these purposes. We may disclose personal data in order to comply with a legal or regulatory obligation. By providing us with your personal information, you consent to our processing your sensitive personal data, such as health data, for the above purposes. If you provide us with information about another person, you confirm that they have appointed you to act for them, to consent to the processing of their personal data including sensitive personal data and that you have informed them of our identity and the purposes (as set out above) for which their personal data will be processed. You are entitled to ask for a copy of the information we hold about you and to have any inaccuracies in your information corrected.

Change of terms and conditions

GroundWork Training may revise these terms and conditions at any time. Any change will be effective once reflected in the text of these terms and published on our site.

Governing Law and Jurisdiction of the Courts

This agreement shall be governed by and construed with English Law and the parties agree to submit any disputes to the exclusive jurisdiction of the English Courts.
